By accessing or using the services provided by Project Simple, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
Project Simple offers website design and development services to individuals and businesses. Our services include but are not limited to website design, development, maintenance, and related services.
Clients are responsible for providing accurate and complete information necessary for the successful completion of the project. Any delays caused by incomplete or inaccurate information are not the responsibility of Project Simple.
All necessary content, including text, images, and any other relevant materials, must be provided by the client within 90 days of the project commencement date. Delays in content submission may impact the project timeline, and Project Simple cannot be held responsible for such delays.
Project timelines and milestones will be agreed upon at the beginning of each project. Project Simple will make every effort to meet these timelines, but delays may occur due to unforeseen circumstances. Project Simple is not responsible for any loss or damage resulting from project delays.
Payment terms will be outlined in the project proposal. A 50% start work deposit is required to initiate the design process and the final balance is due 14 days after the delivery of the first draft design. Failure to complete the payment within the specified timeframe may result in a delay in project completion.
A 7-day cooling off period is provided, starting from the date of the initial payment. After the 7-day cooling off period, no refunds will be issued.
Project Simple retains the intellectual property rights to any design elements or code created during the project. Upon final payment, the client will receive a license to use the website. Unauthorised use or reproduction of Project Simple's work is prohibited.
Project Simple will treat all client information as confidential and will not disclose it to third parties without the client's consent.
Project Simple is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services. The client agrees to indemnify and hold Project Simple harmless from any claims or losses.
These terms are governed by and construed in accordance with the laws of ACT. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Austrlian Capital Territory.
Project Simple reserves the right to update these terms at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the modified terms.
